Nadia Haghighatian is a member of Winstead’s Business Litigation Practice Group, with over a decade of experience litigating intellectual property disputes for clients ranging from inventors and small entities to some of the world’s largest technology companies. 

Drawing from her electrical engineering background, Nadia focuses her practice on patent litigation. She represents clients in matters across a broad spectrum of technology areas, including software, telecommunications, electrical, mechanical, and semiconductor technologies. Her practice also encompasses patent and trade secret disputes within the energy sector, as well as trademark infringement matters.

In addition, Nadia values serving people in need through pro bono work. She has litigated high-stakes asylum and prisoner’s rights cases that have profoundly impacted the lives of her clients and reflect her personal commitment to increasing access to justice.

Outside of the courtroom, Nadia is dedicated to improving the legal profession through leadership and community-building, and she is particularly passionate about diversity, equity, inclusion, and belonging. Throughout her career, Nadia has sought opportunities to lead and elevate others. She has spearheaded internal LGBTQ+ affinity group initiatives and held board positions with several local bar associations and law sections, including the Dallas LGBT+ Bar Association, Dallas Bar Association, Dallas Association of Young Lawyers, and LGBTQ+ Law Section of the State Bar of Texas. Nadia is also deeply committed to mentoring diverse attorneys and law students, and frequently shares her insights through public speaking engagements on topics related to diversity, equity, inclusion, and belonging.

In her free time, Nadia enjoys spending time with family, traveling, and striving for the perfect homemade sourdough.

Semiconductor Technologies

  • Represented a global semiconductor equipment manufacturer and one of the world’s leading chip manufacturers in multiple patent infringement lawsuits involving physical vapor deposition (PVD) technologies; was part of the trial team that secured a take-nothing judgment against the largest patent damages claim in U.S. history
  • Defended a global electronics and semiconductor company in various patent infringement lawsuits relating to, for example, capacitive touch screen technologies, metal-oxide semiconductor field-effect transistor (MOSFET) devices, automatic gain control systems, and signal encoding/decoding systems
  • Represented a global semiconductor and infrastructure technology company in patent litigation involving semiconductor device fabrication
  • Assisted a semiconductor developer in organizing and categorizing a large portfolio of U.S. and foreign patents and applications for valuation and licensing

Software and Networking

  • Represented a multinational cybersecurity company against another security software company in district court litigation and inter partes review (IPR) proceedings involving patents for detecting and classifying malware and other internet threats
  • Asserted a technology company’s patent infringement claims against a global video streaming company in multiple, parallel lawsuits involving content recommendations, adaptive bitrate streaming, container management platforms, and content distribution networks (CDN)
  • Asserted a technology company’s claims against major consumer electronics companies in multiple, parallel patent infringement lawsuits involving 10 patents relating to mobile technologies for battery life conservation, digital content distribution, and authentication
  • Represented a global semiconductor and infrastructure technology company in patent litigation involving 15 patents, including patents relating to audio and video encoding and decoding, optimized graphics processing, and wireless communication systems
  • Asserted a patent owner’s claims in an infringement lawsuit relating to accelerated erasure coding for data storage in distributed computing systems
  • Defended a major airline in several patent infringement actions relating to customer rewards programs, message storage and delivery, website search functionalities, and mobile applications
  • Defended an air travel company in a patent infringement action involving a meta-search engine for comparing airfare pricing information
  • Defended a national jewelry retailer against trade secret misappropriation and breach of contract claims relating to software for tracking warranty repairs

Oil & Gas and Machinery

  • Defended an international oilfield service company in a patent infringement action relating to electric rig control systems; obtained settlement after a favorable claim-construction ruling
  • Represented an oil and gas exploration company in a trade secret misappropriation lawsuit relating to methods and formulas for identifying profitable acreage
  • Defended a major manufacturer of off-road vehicles for mine sites against claims of patent infringement and false advertising

Trademarks

  • Asserted the senior trademark rights of a technology credit union service organization (CUSO) against a major competitor in federal district court and before the Trademark Trial and Appeal Board (TTAB)
  • Asserted a specialty chain retail company’s well-known family of trademarks relating to organization and storage products and services; obtained settlement including client’s primary requested relief

Pro Bono

  • Represented a prisoner in a motion for reduction in sentence under the federal compassionate release statute and obtained an amended sentence of time served
  • Represented transgender prisoners in a Section 1983 civil rights action against more than a dozen defendants affiliated with the California Department of Corrections and Rehabilitation (CDCR) for claims relating to sexual assault, failure to protect, and retaliation
  • Represented a married couple from Pakistan in affirmative asylum applications before the U.S. Citizenship and Immigration Services

Entering two terms together in a search field will behave as though an "OR" is being used.  For example, entering "Antique Motorcars" as a Client Name search will find results with either word in the Client Name.

Operators

AND and OR may be used in a search.  Note: they must be capitalized, e.g., "Project AND Finance." 

The + and - sign operators may be used.  The + sign indicates that the term immediately following is required, while the - sign indicates to omit results that contain that term. E.g., "+real -estate" says results must have "real" but not "estate".

To perform an exact phrase search, surround your search phrase with quotation marks.  For example, "Project Finance".

Searches are not case sensitive.
